About Eschenbach and This Policy

Eschenbach Optik of America, Inc. (“Eschenbach,” “we,” or “us”) is the world leader in the manufacture and distribution of high quality magnification solutions including low vision aids, reading glasses and binoculars. Our general business model involves us offering product to our channel partners (i.e., business partners who are typically eye care or vision rehabilitation professionals), and those channel partners then provide our products to consumers.

Even though only limited aspects of our business interacts directly with consumers, there are certain instances where we handle Consumer Personal Information.   As such, this Privacy Policy explains how we collect, use, share, and otherwise generally process and protect Consumer Personal Information in connection with your use of this website or when you interact with Eschenbach over the phone or in person. Your use of this website indicates your acceptance of the terms of this Privacy Policy.

Children’s Information

This website is intended for adult use only. Eschenbach does not direct any part of our website to children less than 13 years of age nor do we knowingly collect Personal Information from children. By using this website, you represent and warrant to Eschenbach that you are at least 13 years of age.

The Consumer Personal Information We Collect

Eschenbach collects certain Consumer Personal Information from or about the consumer with whom it interacts, including:

  • Contact Information, such as your name, address, email address, telephone number.
  • Payment Information, such as your credit card information, which will be processed by our third party payment processor.
  • Digital Information, such as your Internet protocol (“IP”) address, browser type, device identifiers, and preferences such as language or time zone. We may also use cookies or similar digital technologies to automatically gather statistical data that helps us improve our website and deliver a better and more personalized service.
  • Sensitive Information, in limited situations, we may receive information about your low vision diagnosis or your eyeglass prescription (“Consumer Health Data”). We may use Consumer Personal Information that we collect for a variety of business purposes when it is reasonably necessary to achieve the purpose for which the Consumer Personal Information was collected or processed. For example, we may use information:

  • To respond to your questions and request(s), such as those submitted via our chat feature or in a call to our customer service desk;
  • To process a payment if you buy a service or product from us;

We collect certain digital information, as described above.  We may share this information with our analytics partners, which could be treated as the “sale” of personal information under certain privacy laws. You have the right to opt-out of this processing.  You may opt-out by:

Offline: Eschenbach does not engage in the “sale” of any other types of Consumer Personal Information.

Consumer Data Privacy Rights

If you are a resident in Texas or Nebraska, you may have certain consumer data privacy rights, including:

  • To confirm whether or not we process your Consumer Personal Information and to access or obtain a copy of (as applicable), such data;
  • To correct inaccuracies in your Consumer Personal Information;
  • To delete your Consumer Personal Information;
  • To obtain a copy of your Consumer Personal Information, if the data is available in a digital format and the processing is completed by automated means; and
  • To opt-out of targeted advertising, the sale of personal data, or certain automated profiling in furtherance of decisions that produce legal or similarly significant effects concerning you. We currently do not engage in targeted advertising or automated profiling as, as defined under relevant laws. 

How to Exercise Your Rights.  If you are a resident in Texas or Nebraska, you may exercise your consumer data privacy rights by sending an email to info@eschenbach.com or contacting us at our toll-free phone number: (800) 487-5389. Please indicate in your communication your state of residency for Eschenbach to know which relevant law applies.

Identity Verification. For your protection, we will verify your identity prior to honoring your consumer request; if we are unable to do so, we may deny your request. You can also designate an authorized agent to make a request on your behalf. To do so, we may require that you confirm directly to us that you have provided the authorized agent permission to submit the request, and even if you elect to use an authorized agent to make a request, we may verify your identity directly with you.

Note, in certain instances, we may deny your request in whole or in part, such as if we cannot verify your identity. If we deny your request, we will explain our reasons.

Appeal. You may have a right to appeal our decision with regard to your request. To do so, please send an email to info@eschenbach.com with the word “Appeal” in the subject line.

We have implemented appropriate measures designed to secure your Consumer Personal Information. We will take reasonable steps to ensure that your data is treated securely and subject to appropriate safeguards in accordance with this Privacy Policy and applicable legislation.

We may revise our Privacy Policy from time to time. We will post any revised version of the Privacy Policy on this website.
